1. AGREEMENT TO TERMS

If you are using our services on behalf of an organization, you represent that you have authority to bind that organization to this Agreement.

• Mixing and mastering

• Beat licensing

• Artwork and cover design

• Video editing

• Gigs Announcements

Services are delivered according to agreed packages and confirmed payments.

2. INTELLECTUAL PROPERTY

All branding, frameworks, service systems, and original content on the Site are the property of K.O.T.H unless otherwise stated.

You may not:

• Reproduce

• Redistribute

• Modify

• Commercially exploit

any content without written consent.

Artists retain ownership of their original works unless otherwise specified in a signed agreement.

3. RULES OF CONDUCT

You agree not to:

• Upload illegal, defamatory, or infringing content

• Submit content you do not have rights to

• Use the Site for unlawful purposes

• Attempt to hack, disrupt, or interfere with operations

• Impersonate others

Violation may result in suspension or termination.

4. PAYMENTS AND REFUNDS

All payments must be made in full before service delivery unless otherwise agreed.

Unless explicitly stated:

5. NO GUARANTEES

While we aim to improve exposure, sound quality, and reach:

K.O.T.H does not guarantee:

• Viral success

• Chart placements

• Record deals

• Streaming numbers

Results depend on multiple external factors beyond our control.

6. LIMITATION OF LIABILITY

To the fullest extent permitted under South African law:

K.O.T.H shall not be liable for:

• Indirect or consequential damages

• Loss of profits

• Loss of business opportunities

• Platform algorithm changes

• Third-party distribution platform issues

Your use of our services is at your own risk.

7. TERMINATION

We reserve the right to:

• Suspend services

• Terminate agreements

• Refuse service

if you breach these Terms.

8. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa.

Any disputes shall be resolved under South African jurisdiction.
